On February 8, 2024, the Federal Communications Commission ruled unanimously that voices generated by artificial intelligence are &#8220;artificial&#8221; within the meaning of the Telephone Consumer Protection Act, which means a call placed with one falls under the same prohibition as a prerecorded message: illegal to a cell phone without the called party&#8217;s prior express consent, and for a marketing call, prior express written consent (<a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DOC-400393A1.pdf\">FCC, February 2024<\/a>). Nobody on a cold list has given that. The ruling did not create a gray area. It removed one.<\/p>\n<p>So the phrase &#8220;AI dialer&#8221; describes two very different products, and the difference is which side of the call the AI is on. On the agent&#8217;s side, AI can transcribe, summarize, score, schedule, coach and fill in the record, and none of that touches the homeowner. On the homeowner&#8217;s side, AI that speaks to a cold prospect is a prerecorded call with better diction, and the vendors selling it as conversational outreach are selling a violation with a dashboard. This piece sorts the functions, gives you the questions that expose which product you are looking at, and is operational education rather than legal advice.<\/p>\n<h2 id=\"the-rule-in-one-paragraph\">The rule, in one paragraph<\/h2>\n<p>The statute at <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/47\/227\">47 U.S.C. 227(b)(1)(A)(iii)<\/a> prohibits calls to a cellular number using an artificial or prerecorded voice without prior express consent. Roughly four in five American adults live in wireless-only households, so a cold list is a cell list. The 2024 ruling placed AI-generated voice squarely inside &#8220;artificial,&#8221; however natural it sounds and however well it handles a question, and the FCC noted that state attorneys general can now pursue the use of the AI voice itself rather than only the fraud it might be attached to. Separately, the <a href=\"https:\/\/realdialer.com\/state-mini-tcpa-laws-for-real-estate-agents\/\">state mini-TCPA laws<\/a> in Florida, Oklahoma and Maryland restrict automated dialing under definitions wider than the federal one, and an AI system that selects and dials numbers sits inside them. The <a href=\"https:\/\/realdialer.com\/tcpa-for-real-estate-agents\/\">TCPA piece<\/a> covers the rest of the statute. Everything the AI does for the agent is legal, useful in proportion to how well the agent reviews it, and dependent on the recording-consent discipline in the <a href=\"https:\/\/realdialer.com\/call-recording-consent-for-real-estate-agents\/\">call recording piece<\/a>. Everything the AI does to the homeowner on a cold list is prohibited. A product that keeps the AI on the agent&#8217;s side of the line is a tool. A product that puts it on the homeowner&#8217;s side is a liability that happens to be well designed.<\/p>\n<h2 id=\"the-questions-that-expose-which-product-it-is\">The questions that expose which product it is<\/h2>\n<p>Vendors in this category are good at describing the agent-side functions and vague about the homeowner-side ones, because the second group is where the demo is impressive and the law is against them. Five questions, asked plainly, sort them.<\/p>\n<p><strong>Does any AI-generated audio ever reach a homeowner who has not given prior express written consent?<\/strong> The answer is yes or no. &#8220;Our system is TCPA compliant&#8221; is not an answer to it. A vendor who cannot say no is selling artificial-voice calls.<\/p>\n<p><strong>When the AI &#8220;qualifies&#8221; or &#8220;warms up&#8221; a lead before the transfer, who spoke first?<\/strong> If the AI did, the call was made with an artificial voice before any human was on it, and the transfer does not cure that.<\/p>\n<p><strong>Does the system send texts to numbers we upload, and what consent does it check first?<\/strong> A platform that texts a cold list is making autodialed calls to cells, and it cannot truthfully register the campaign with the carriers, as the <a href=\"https:\/\/realdialer.com\/texting-rules-for-real-estate-agents\/\">texting rules<\/a> explain.<\/p>\n<p><strong>When the AI transcribes my calls, is the homeowner told the call is being recorded, and can I turn recording off per state?<\/strong> Transcription is recording. A product that transcribes silently in all-party states has moved the recording problem onto you.<\/p>\n<p><strong>What does the AI do when the homeowner says &#8220;don&#8217;t call me again&#8221;?<\/strong> If the answer is anything other than &#8220;flags the record as internal do-not-call immediately, across all lists, for five years,&#8221; the product has not read <a href=\"https:\/\/realdialer.com\/do-not-call-rules-for-real-estate-agents\/\">the rule<\/a> it claims to comply with.<\/p>\n<h2 id=\"what-ai-in-a-dialer-is-actually-good-for\">What AI in a dialer is actually good for<\/h2>\n<p>Set the voice agents aside and the agent-side functions are worth having, because they attack the two failures that run through every prospecting piece on this site: the record that never gets written, and the follow-up that never gets made.<\/p>\n<p>The <a href=\"https:\/\/realdialer.com\/what-to-record-after-every-prospecting-call\/\">call record<\/a> asks for eight fields in thirty seconds, and the field that agents skip is the homeowner&#8217;s verbatim sentence. A transcript captures it exactly. A summary that proposes the outcome, the date and the figures, for the agent to confirm with one click, turns thirty seconds into ten and makes the record more accurate than memory ever was. That alone changes what the second call sounds like, because the second call opens with the homeowner&#8217;s own words, and now they are the actual words.<\/p>\n<p>Coaching is the second. The <a href=\"https:\/\/realdialer.com\/should-an-isa-make-your-cold-calls\/\">ISA piece<\/a> puts the agent&#8217;s ability to evaluate calls at the center of whether to delegate them, and a searchable library of transcribed calls, with the outcomes attached, is how an agent or a team lead finds the moment in the opener where the homeowner disengaged. That is a review tool, not an outreach tool, and it depends entirely on the recording announcement having been made.<\/p>\n<p>Scheduling and sorting are the third and fourth, and they are modest. An AI that reads &#8220;sixty days before the lease ends in October&#8221; and puts the call in the priority lane on August 3 is doing what the <a href=\"https:\/\/realdialer.com\/landlord-lease-end-call\/\">lease-end call<\/a> needs. An AI that sorts tonight&#8217;s list by the likelihood of an answer at this hour is a small edge. Neither is transformative. Both are legal.<\/p>\n<h2 id=\"the-two-things-to-keep-in-mind\">The two things to keep in mind<\/h2>\n<p>The first is that the agent-side functions are only as good as the review. A transcript with a misheard number, a summary that flattened &#8220;not until the kids finish school&#8221; into &#8220;not interested,&#8221; or a record field auto-filled with a guess is worse than a blank, because it will be trusted. Read the summary. Correct the words. The AI drafts; the agent signs.<\/p>\n<p>The second is that the appeal of the homeowner-side products is real, and it should be resisted for a reason beyond the statute. The entire case for prospecting by phone, made across every script on this site, is that a person called, said who they were, and listened. An AI voice that does that convincingly has not solved the problem of cold calling. It has manufactured the one thing the homeowner was trying to detect, and the FCC&#8217;s ruling, the state statutes, and the plaintiffs&#8217; bar are all pointed at exactly that manufacture.
