RealDialer Calling Terms

These are the terms for placing calls with RealDialer. They sit on top of the RealDialer Terms of Service rather than replacing it, and where the two differ the stricter obligation applies. They are the terms an account holder agrees to inside the product before any call is dialed. Every acceptance is recorded against the version above.
RealDialer is a product of CloseDaily LLC. In these terms, "you" is the account holder and anyone calling under the account, and "we" is CloseDaily LLC.
1. You are the caller of record
RealDialer is the equipment. You decide who is called, what is said, and why the call is lawful. Federal and state telemarketing law reaches the seller or the person on whose behalf a call is made, and on this platform that is you. We do not review your lists, script your calls, or approve your reasons for calling.
If you call on behalf of another business, both of you carry that responsibility, and you are the one answerable to us for the account.
2. You have a basis for every call
Before a number goes on a list, you have a lawful basis to call it. In practice that is an existing business relationship, prior express written consent that you can produce, an inquiry the person made of you, or a call that is not a solicitation at all. A number passing a scrub is not a basis. Owning a phone number is not a basis. A number appearing in public records is not a basis.
You keep the proof. If a call is challenged, the record of consent or relationship has to come from you, and it has to be capable of identifying the specific person and the specific number.
3. Do not call handling
RealDialer checks numbers against the federal Do Not Call Registry data your account is licensed to use, against your own internal do not call list, and against numbers marked do not call anywhere on the platform. Registry flagged numbers are blocked by default. An account may choose to call them, and choosing that is you asserting a relationship or written consent for every one of those numbers.
A do not call request is honored immediately and permanently, on your account and on ours. It cannot be cleared to call somebody again. Federal rules require you to honor such a request within a reasonable time not to exceed thirty days; we do it at once, and you do not get to opt out of that.
Several states run their own registries and their own rules on top of the federal ones. Where a state rule is stricter, the stricter rule applies to that call.
4. Calling hours
Federal rules limit telemarketing calls to between 8am and 9pm in the called party's local time. RealDialer holds calls outside that window based on the called party's own time zone, and holds to the stricter hours that some states set. Do not work around that gate. If you believe a state rule we hold is wrong, tell us and we will check it.
5. Attempt limits, pacing, and rest
Your account ships with a per day attempt limit, a minimum gap between attempts, and no lifetime ceiling. Those are defaults chosen to keep an ordinary calling day inside the rules. They are not law, and they are yours to set. You may raise them, lower them, or remove the ones that are optional.
We do not decide how many times your business may call its own prospect over the life of a relationship. Where a specific rule caps attempts, that cap applies and RealDialer enforces it regardless of your setting. Everything above that floor is your call and your responsibility.
Changing a limit in the direction of more calling is recorded, and you are asked to agree again when you do it.
6. Abandoned calls and predictive dialing
If more lines are dialed than there are people to answer them, some answered calls are abandoned. Federal telemarketing rules cap abandonment at three percent of answered calls, measured over each thirty day period for each calling campaign, and require that an abandoned call play a recorded identification message within two seconds of the greeting. RealDialer measures that rate, plays that message, and enforces the cap. Turning the enforcement off is not on offer.
Predictive pacing and rapid fire dialing are off unless you turn them on. With them on you reach more people per hour and you abandon more calls. RealDialer turns rapid fire off for the remainder of a call block the first time a call is abandoned.
7. Caller identification
Calls carry a number that reaches you and identifies you truthfully. Numbers on the account are registered for caller name display and for the attestation carriers require. Do not use a number, name, or displayed identity intended to mislead the person receiving the call about who is calling. Federal law makes transmitting misleading caller identification with intent to defraud or cause harm a violation on its own.
Numbers on the account are provisioned by us for your use on this platform. They are not portable out mid term by default, and a number that draws sustained carrier complaints can be withdrawn.
8. Recording
Recording is off unless you turn it on. Whether a recording is lawful is decided by where the parties are. Some states require only one party to consent, and some require every party. In an all party consent state you announce the recording at the start and you do not proceed on that call if the other person objects. RealDialer surfaces what the called party's state requires, but the announcement and the judgment are yours.
We store recordings for the retention period your account sets and no longer. Recordings and transcripts belong to your account. We access them to operate the service, to answer a complaint or legal process, and for nothing else.
9. Prerecorded voice, artificial voice, and text messages
Delivering a prerecorded or artificial voice message to a residential or wireless number for a marketing purpose requires prior express written consent from that person. An artificial or AI generated voice is treated the same way. Voicemail drops are subject to the same rules as the calls that carry them.
Where RealDialer sends text messages, the same consent standard applies, plus a working reply to stop.
10. Data you bring
Lists, contacts, phone numbers, and notes you upload stay yours. You warrant that you have the right to hold and to call what you upload, and that you did not obtain it in a way that forbids this use. We process it to run the service for you. We do not sell it and we do not call it ourselves.
Numbers get reassigned. A number that was your customer's last year may belong to a stranger today. Keeping your data current is part of having a basis to call it.
11. What the platform will not do
RealDialer is not for debt collection outside the rules that govern it, for calls that harass or threaten, for calls that disguise who is calling, for buying lists of people who asked not to be called, or for any calling program whose design depends on the limits above not being enforced. We do not sell access to consumer data, and we do not provide a way to bypass a suppression list.
12. We can stop an account
Carrier complaints, registry violations, spam labeling that reaches our other customers, or calling patterns that put the platform at risk can end an account's calling with no notice. We would rather talk to you first and usually will. Non payment, fraud, and legal process are the exceptions where we act first.
13. Responsibility
You are responsible for the calls you place and for what results from them, including claims, penalties, and defense costs arising out of your calling, your lists, your consent records, or your use of the platform against these terms. We provide the service as described and do not promise a specific outcome, connect rate, deliverability, or regulatory result. Nothing here is legal advice, and product material about compliance is general information rather than counsel for your situation.
14. Changes
These terms are versioned. When they change materially you are asked to agree again inside the product before your next calling session, and the acceptance record names the version you agreed to. The current version is at the top of this page.
